The Daighila Deportation Debacle: Some Thoughts
More insights into the recent Daihila debacle.
Here’s what our good friend Steve Towson (from the Brisbane based band Steve Towson & The Conscripts) wrote to me via MySpace:
Just read the article on Daighlia and their following comments – some interesting comments and some hmm weird thoughts…
I was wandering if it would be possible to write an article for Ricecooker about Immigration and Customs in OZ and what happens here for Australians and what Malaysians or anyone MUST understand from a basic rights point of view.
for example any more then 3 cds, cassettes etc of a singular release (eg. Steve Towson “Shah Mat” even if an Australian brings it in) is considered a violation of customs. For an Australian this means a fee; for a foreign citizen, it’s a violation of customs and reason to reject application.
Saying your are touring as a musician and not working is also a violation of a tourist visa as it is technically work and a person should be using a Entertainment Visa. Daighlia were lucky to get away with a slap on the wrist.
Entertainment Visas are complicated process, Ive looked into it $$$$$tousands of dollars to apply and you need criminal record and health records certified by your home government
anyway – that is a brief speel. Let me know you thoughts and if you see the Daighlia crew – pass on my sympathies and regrets, customs and immigration anywhere in the world are fucked places.

when i was there for the first time many years ago I had with me about 10 copies of Carburetor Dung’s The Allure of Manure tapes and the custom officers asked me about it.
I told them that it’s my own band’s release and that they are gonna be given away to friends I meet all around Australia. This was at the Brisbane’s airport.
The officers let me go after laughing at the name of the band. “Carburetor Dung?,” they snickered and then waved me away.
But I guess things have changed a lot since then.

daighila entered OZ as tourists. daighila were indeed. thus they do not need entertaiment visa. they are not a band with any major release. not signed to any company. no agent brought them in. no nothing. the intention was to go there and sightseeing and to reduce the cost, they would stay over at friends’ places. they did not carry with them any materials (cd, cass, t-shirt, etc) that would indicate themselves as a band. none brought any musical instruments, not even a drum sticks or key. they did however travel light. three mistakes. first, they flew in during non-peak hour.secondly, to travel with one backpack for two (2) weeks could possibly classify you as an immigrant entering the state for work – assumed that you would purchase new clothes etc in OZ. thirdly, very little cash. with limited cash – hey, who brings with them a lot of cash when traveling nowadays, it’s not safe maa! when they showed their atm cards (which can be use at any atm machines) and wanted the authorities to check on the credit balance, the authorities ignored their request. they choose not to listen.
these kid; pays for the their own flight tickets, foods, other travel expenses and so forth. they wanted to go and see the opera house, kangaroos, koalas, kings cross (opps), surfing at gold coast, etc etc. some might be wondering why im even bothered to reply to every post related to this. reason being because i’m supposed to tag along but canceled due to other daunting commitment. i could had been in their shoes….we were supposed to travel from melbourne to sydney all the way up to brisbane and gold coast. we supposed have a lot of fun. we were supposed to spend every single ringgit we earn from low paying jobs we have in malaysia to support the OZ tourism campaign as promoted by the ever so lovely daphne iking on tv3 (or was it ntv7, i’m not sure, still it belongs to media prima). gosh.
Dean, I’m sure you’re fukking bored with the questions and speculations BUT we do need to get to the bottom of this to find out solutions for other bands planning to tour Australia.
Thanks for the new info. We didn’t know that they didn’t bring merchandising nor musical equipment there. That’s a good thing to know.

Yes joe, you’re fukin rational. Don’t let the ignorance be our bliss. Lots of business today is still running strongly because of these kinda ‘under table’ deal. We’ve got to know how to deal with them. Paperwork just about to ‘seal’ and ‘cover-up’ everything and make ’em look nice & perfect to people’s eyes. There’s too many secret there we only can learn thru experience.

hehe…no lah joe. not bored at all. i was just worried that some people might hv thought who the hell is this “dean” fella. huhu… we are indeed very thankful that many friends come out & show their concern. this is not the first time it happen and would not be the last too if we don’t learn from this experience. this is a good channel of discussion indeed. people may have opposing views on how things (should) work but in the end of the day, we all learn something,aite? so, keep ’em coming yah! 😉
encik dean? for us here the blokes with the name ‘din’ is the only one our friend ‘budin petai’ who works for labour resources centre in bangsar. i dont mind whoever you’re or you might turns into different shapes soon..just ponder to think.
Some tips: come in on separate flights, don’t give any indication you’re in a band-there’s all kindsa little tricks to get by this kinda shit. Saying that, it seemed that the Aussies were determined to send these guys back no matter what so…
To me the real issue is ‘abuse of power’ by the OZ immigration officer. Since no adequate ‘right to be heard’ was given the Daighlia, I believe that they already made up their mind not to entertain any explanation by Daighlia.
A funny incident also happened to one girl from Malaysia who was deported like Daighlia few years back just because she told the OZ immigration officers that she wanted to take care of her sister’s son while staying temporarily in OZ. The smart OZ immigration officers somehow interpreted that she wanted to work with her sister with salary paid. Of course she didn’t have the working visa! On this reason alone, she was deported!
This sort of unpleasant incidents not only happen in OZ airport, but has already happened in London or US. It depends on luck sometime, how you manage to convince them or else they will send you back just because they don’t like you face!
It’s a good tips by fying with seperate flights but it’ll burden the band members logistically for preparation etc. especially to those who first time arrive in OZ. It should be ok flying with the same flight but just pretend you don’t know each other when lining up at the check in counter. Don’t show you band attitute, act solo.
Bring reasonable amount of money, credit/bank card, return ticket and show clearly your address of accommodation (friend’s house) for example. Just tell them your visiting purpose, the rest agenda keep it as top secret. Again, it depends on luck!

Hey folks.
Just a quick word in regards to Musicians travelling internationally through customs and immigration.I talking with some promoters/bands here in OZ about the do’s and dont’s for bands in regards to touring and if there are any Malaysian bands/promoters that want to email their experiences and recommendations that would be great. I’ll post the info once compiled so that future touring bands know what people are recommending.
Knowledge is power. The collective sharing of our experiences can only help to make the regions music scenes stronger and more exciting.
For myself, I’d rather be toured to other ‘secured country’ than taking the risky goin’ to Oz. Fuk, I cant imagine after losing a thousands of RM, then end up by sending back. I think you guys are fukin rich and just love punk for hobby. Kampung punks & Felda punks will surely understood what I’m talking bout..

Pijan there is no such thing as ‘secured country’ but if you are white its all a different story when come to airport. this is really all about how immigration work and dont. especially after S11 evrything about immigration take new turn. basically more paranoid. yesterday there is this rediculous news in london heathrow terminal 5. it say this

sicko – incase you dont know megatron ‘he’ is a cherecter from the film transformer. whats the verdict on this? as you know london is fucked up by ‘terrorist’ and they are strict bout it and the guy who got kick out is Mr Brad jayakody (brown skin and asian looking). the rest you just imaginelah
joe how to improve this? if you really want to travel and are on low budget there is alway thing you need to know, not necessarily as band members but traveller. first u must have adrees of your friend and phone number. yes be prepared as an individuals. dont be too groupy, jakun or too happy looking laughing etc. there is no strict order of behaviour but most immigration officer (airport) have basic code to observe people behaviour in the airport. dont need to take different flight just split 2 person is fine
dressing is important, if you wanna make fashion statement from hair to torn jeans dont do it in the airport. i usually wear short all the time bcos i love showing my tatto off. but airprot i wear jeans/pants and a clean long sleeve/sweater. be clean and not smelly. to have black or brown skin is enought to be very seductive for any immigration officer to kick your ass. and if you over dress you will also get it.
it is countless time i was in waiting room (mainly Narita airport) with african and indian national who dressup like a bisnessman complete with tie and name card..they still get it man i mean isaw some are crying because they are not allowed to get in TOKYO. they send them back and no explaination. infact they are alwasy the main suspect i mean those who overdress. i also understand some bangladeshi workers have to rent full suit complete with tie to enter Tokyo. and it is also common for me to notice once they pass through the gate they go to toilet and change.
you must think about your dressing and manners in airport.
at the end it is true this is all depend on how lucky you are and how you talk to the officer but basically if they have bad sex and hate your face…off you golah. nothing to say already.
however i think to be thrown away by the immigration dept is no fucking joke man. its sickening. after more then 20 years of travelling and get so many all kind of racist shit in the immigration dept i still love travelling. one thing i learn you must always check each country you are going what is happening there (where you go)
my point here is dont give up but just learn some very basic thing you need to do before flying and theres really no need to worry about guitar or cd’s. we have all the right to be a musician and theres no such law you cant bring guitar and cd’s as long its not more then 50.
i just got back from tokyo 3 days ago and when im in the NARITA the officer stop me and ask me what am i doing with the guitar. i say i play music then he check my bag and i say i sell some of this cd to friend. and he ask are you going to play music on the street? i say im not sure yet but i have a gig and showed the flyer. he let me go and 1 thing i know there is no law that musician cannot play on the streeet in japan. and i know i need ‘permit’ to perform…and there it goes the officer dont give a shit and just let me go.

I thought this thread was about overseas musicians getting into other countries but it’s turned into a discussion about dick-measuring contests and …oil? Anyhoo…’ …there is no such thing as ’secured country’ but if you are white its all a different story when come to airport.’–Not neccessarily-when Frightener went on tour with Pulling Teeth they came in separately, etc.-their guitarist told me that another English band had tried to tour the States and got their asses turned back. Even Trencher and the great Extreme Noise Terror were on the downlow on their U.S. tour-E.N.T. even used a lot of (their tourmates) Phobia’s gear–Frightener’s guitarist Steve told me for the U.K. it’s like 300 quid a band to get an artist visa–in stark contrast, in the States it’s like $4,000 A PERSON. I mean shit..even Lily Allen got denied..as did Amy Winehouse–it’s getting tougher all over. But in the case of Daighila, the Aussie situation is pre-aggravated by the various Vietnamese/Indonesian boat people/fishermen they (Aussie immigration) pick up–this makes them predisposed to be suspicious of Asians/Polynesians, thus contributing to the our lads in Daighila’s misadventure–just come to fucken Ohio–I’ll be waiting at the airport to straighten out any bullshit if it comes up.

just a quick word for any bands coming out to OZ real soon. It is illegal to use your mobile phone while going through customs or immigration. However, having said that it could be possible to accidentally sms a friend/tour manager (whatever you call them) saying “things not good, can you call”
only 1 quick sms is needed. that way your friends will know whats happening and they can then also proceed to lobby the immigration department on your behalf.

the reason me and few of my friend use our real name is bcos that way we make sure we are serious about what we post or write. if we are rude we are rude and it doesnt matter and we know people know who we are. thats actually one way to be responsible about what you say. it also save us from going into creepy bullshit attittute of iresponibility. punk is about being responsible and fuck shit out and no fear to be arrested. and i think this is not the malays problem with internet and nama palsu but all kind of peoples/race problem

Who’s ‘malay’? For me it’s only being politicized by the rulers! In Malaysia, UMNO(United Malay National Organization) itself is made of english words so how can u judge them so sacred, so eagerly to help the poor? In general, lower class people here cant’ speaks English very well or can’t speaks at all. Do they honestly have any sympathy for poor peoples?
